Findings of Fact: The Complainant is a company incorporated in London, UK. The Complainant is the owner of the Community trademark registration No. 001746147 “VIRGIN MOBILE (logo)”, filed on September 13th, 2000 and registered on November 18th, 2002. The Complainant has submitted a list of the details of national trademark registrations VIRGIN MOBILE that it owns. The Complainant also states that it has a validated entry at the Trade Mark Clearinghouse, under SMD 0000003261444217279733-1 (VIRGIN) and 0000003451444218179876-1 (VIRGIN MOBILE). The Complainant contends that it has a significant reputation and has a vast amount of goodwill in the VIRGIN and VIRGIN MOBILE names globally. The Virgin Group originated in 1970 and has since expanded into a wide variety of businesses. It now comprises over 200 companies worldwide operating in 32 countries including throughout Europe and the USA and employs in excess of 40,000 people, generating an annual turnover of 4.6 billion pounds. Virgin Mobile was established in 1999. In 2004 the business was floated on the London stock exchange with an enterprise value of £811 million. The business now operates in a range of countries, including but not limited to the United States, Canada, Singapore, India, Australia and Columbia. In 2008 the combined worldwide turnover for the business totaled 1.8 billion (£s). Respondent registered the disputed domain name without having any right or legitimate interest in respect of the mark. Complainant states that it has contacted Respondent, who offered to sell the domain name to Complainant for five thousand euros. The website in relation with the disputed domain name is inactive registration, as proved by the screenshot of the URL: http://www.virginmobile.xyz/ submitted by the Complainant. |
Even though the Respondent has defaulted, URS Procedure 1.2.6, requires Complainant to make a prima facie case, proven by clear and convincing evidence, for each of the following three elements to obtain an order that a domain name should be suspended.
[URS 1.2.6.1] The registered domain name(s) is/are identical or confusingly similar
to a word mark: Determined: Finding for Complainant The Complainant is the owner of the Community trademark registration No. 001746147 “VIRGIN MOBILE (logo)”, filed on September 13th, 2000 and registered on November 18th, 2002. The Complainant has submitted a list of the details of national trademark registrations VIRGIN MOBILE that it owns. The Complainant also states that it has a validated entry at the Trade Mark Clearinghouse, under SMD 0000003261444217279733-1 (VIRGIN) and 0000003451444218179876-1 (VIRGIN MOBILE). Complainant submits proof of current use of the VIRGIN MOBILE mark. Examiner finds that the disputed domain name <virginmobile.xyz> is identical to the Complainant’s trademark, as the gTLD is not relevant for a finding under URS 1.2.6.1. Examiner finds that Complainant has established the first element under URS 1.2.6.1(i). [URS 1.2.6.2] Registrant has no legitimate right or interest to the domain name. Determined: Finding for Complainant Respondent has not filed a Response. Complainant has not authorized Respondent to use its registered VIRGIN MOBILE trademark. Examiner finds that the Complainant has established that the Respondent has no rights or legitimate interests in <virginmobile.xyz>.
[URS 1.2.6.3] The domain name(s) was/were registered and is being used in bad faith.
Determined: Finding for Complainant Complainant submits evidence that the domain name <virginmobile.xyz > resolves to an inactive website. Hence, it is apparent that Respondent had Complainant in mind when registering the disputed domain name and that Respondent registered the domain name either with the purpose of selling it to Complainant or to a third party and prevent the Complainant from reflecting the mark in a corresponding domain name. Examiner finds that the Complainant has established the element under URS 1.2.6.3. FINDING OF ABUSE or MATERIAL FALSEHOOD The Examiner may find that the Complaint was brought in an abuse of this proceeding or that it contained material falsehoods. The Examiner finds as follows:
DETERMINATION
After reviewing the parties’ submissions, the Examiner determines that the Complainant
has demonstrated all three elements of the URS by a standard of clear and convincing
evidence; the Examiner hereby Orders the following domain name(s) be SUSPENDED for
the duration of the registration:
