The length of an arbitration proceeding depends on a number of factors, including the type of arbitration claim being filed, the number of parties involved, and the flexibility of the parties’ (and their representatives’) schedules. Most arbitrations at the FORUM, outside of large and complex commercial matters, can be completed by the arbitrator within three to six months. This is significantly less time than it takes to litigate a case; in August 2004, the California Dispute Resolution Institute found that the median time to resolve a consumer or employee dispute by arbitration is 104 days1. By comparison, cases involving consumer goods and employment claims take 650 to 720 days to be resolved court2.
