National Arbitration Forum Mediation Process

 
Two or more parties agree to mediate their dispute. The FORUM Mediation offers to contact the parties, if necessary.

The mediation process is initiated by submitting a Request for Mediation form or otherwise contacting the FORUM Mediation. We will provide a dedicated mediation coordinator as a point of contact for all parties' communications prior to the mediation.

The FORUM Mediation will provide information to the parties about mediators who have the right qualifications and experience to resolve the case. If the parties cannot agree on a mediator, we can administer a strike-and-rank mediator selection process.

The FORUM Mediation works with all parties to find a mutually convenient time and location for the mediation. We administer mediations under statutory, government and pre-existing mediation requirements. We also maintain a set of procedures to guide the mediation.

The FORUM Mediation mediators guide the mediation process: they uncover interests of the parties, facilitate communication, and develop creative settlement options.

The FORUM Mediation can assist parties as they finalize their settlement agreement. If settlement is not immediately achieved, we can provide and administer additional mediation sessions or alternate ADR process at the parties' request.
