February 8, 2012 The National Arbitration Forum, dispute resolution provider for ICM Registry’s RES and CEDRP dispute resolution mechanisms, releases the following statistics for RES cases filed through January, 2012.
From December 6, 2011 through January 31, 2012, FORUM received fifteen RES filings that were accepted. Two were rejected for extreme noncompliance and are not included in any of the published statistics. Preliminary take down decisions, advertised to be issued within two days where possible, in many cases were issued much faster. Several cases received a preliminary take down decision on the same day as, or within one day of, filing. So far, all preliminary and final decisions have been in favor of complainants. All but one of the first fifteen filings were for trademark abuse.
Domain name registrants responded in six cases; respondents may still respond in the remaining six closed cases. Thirteen different specifically-trained Evaluators were used in these fifteen cases.
As provided in the Policy and Rules, RES decisions are not published, but statistical information about cases may be published periodically by the FORUM and ICM Registry.
As required by the RES Policy, updates to the Policy or Rules will be published ten days before they take effect. An update to the Rules was released by ICM Registry on February 7, 2012. Click here to view the updated Rules.
