FINDINGS and DISCUSSION
Findings of Fact: Complainant Leslie Brown owns U.S. Trademark Registration No. 5189596 for the mark HEADSHOPFINDER. The disputed domain name headshopfinder.org is an online directory of smoke shops, vape shops, cannabis dispensaries and related businesses. Complainant's HEADSHOPFINDER trademark is the sub-title for smokeshops.com, which is also a directory of smoke and vape shops and related businesses. Thus, the parties are direct competitors. Complainant owns the headshopfinder.net and headshopfinder.com domain names. In a previous dispute, the domain name headshopfinder.net was awarded to Complainant. |
Even though the Respondent has defaulted, URS Procedure 1.2.6, requires Complainant to make a prima facie case, proven by clear and convincing evidence, for each of the following three elements to obtain an order that a domain name should be suspended.
[URS 1.2.6.1] The registered domain name(s) is/are identical or confusingly similar
to a word mark: Determined: Finding for Complainant The examiner finds that the disputed domain name is, for all intents and purposes, identical to the HEADSHOPFINDER trademark. The domain name incorporates the mark in full, adding only the generic top-level domain ".org." As noted above, the evidence indicates that Complainant has a national registration for its HEADSHOPFINDER trademark. [URS 1.2.6.2] Registrant has no legitimate right or interest to the domain name. Determined: Finding for Complainant There is no evidence that Respondent has legitimate rights or interests in the disputed domain name.
[URS 1.2.6.3] The domain name(s) was/were registered and is being used in bad faith.
Determined: Finding for Complainant The Examiner finds that the disputed domain name was registered and is being used in bad faith. In view of the fact that the parties are direct competitors in providing certain online directories, as well as the previous decision awarding Complainant the domain name headshopfinder.net, the Examiner finds that Respondent registered the domain name primarily for the purpose of disrupting the business of a competitor under URS 1.2.6.3c. The evidence further indicates that, by using the disputed domain name, Respondent intentionally attempted to attract for commercial gain Internet users to its website by creating a likelihood of confusion with Complainant's mark as to the source, sponsorship, affiliation or endorsement of Respondent's website and/or the products or services found therein. FINDING OF ABUSE or MATERIAL FALSEHOOD The Examiner may find that the Complaint was brought in an abuse of this proceeding or that it contained material falsehoods. The Examiner finds as follows:
DETERMINATION
After reviewing the parties submissions, the Examiner determines that the Complainant
has demonstrated all three elements of the URS by a standard of clear and convincing
evidence; the Examiner hereby Orders the following domain name(s) be SUSPENDED for
the duration of the registration:
